Criminal law is based on the criminal laws of various countries in the world. It is a scientific study of the relationship between crime and punishment, criminal responsibility, and criminal punishment. It belongs to the category of departmental law and is one of the most important disciplines in departmental law.

As a science to study criminal law, it emerged with the emergence of criminal law. In the long historical development process, with the continuous deepening of human understanding of crime and punishment, a large number of criminal law cultural heritage have been accumulated and become an important part of human civilization. In ancient China, the criminal law was very developed. At that time, the main part of the discipline was to study the knowledge of criminal law, that is, the current criminal law. For example, during the Spring and Autumn Period in China, there was a so-called "criminal name study." However, criminal law as an independent discipline only emerged in modern times. It is generally believed that the publication of the book "On Crime and Punishment" by Beccaria, a famous Italian criminal jurist in 1764, marks the official birth of modern criminal law. Afterwards, with the continuous efforts of funds from Erbá, Longbroso, Phil, Liszt and others, the criminal classical school and the criminal positivism school (including criminal anthropology and criminal sociology school) emerged one after another. The criminal law theory system was established and developed. .
